I don't know if you've been treated unjustly, but it is to your own advantage to do that. I don't think they have been treated unjustly. The rule is that minifigures must be complete to list them as minifigures. It wasn't complete, so it was removed as it had been reported. I don't think BL staff are making judgements about whether they should be allowed to waive the rules in particular cases. The rule is there and they apply it. It broke a rule and it was removed. The unjust bit is that they are not inventoried so sellers do not get the opportunity to part them out, so these are somewhat different to other incomplete minifigures.
