Yes, it is a minifigure with two distinct parts that are marked as cannot be
inventoried and can be sold incomplete under the minifigure entry even if it
does not contain both parts.

And if you are allowed to leave out the lower part of the minifigure assembly
but still sell the other 50% of the complete figure using the minifig entry,
then why not allow the lower part of the assembly to be sold that way .... making
many sellers millionaires on paper!
