Precision: You’re talking about the “Studio Gallery terms,” not the “Studio terms.”

Also it says no brand names yet on the published studio creations I see dozens
of brand name cars, and movie based creations.

Summary/rewording:

1. There’s different levels of access:
— Private: the design is not on the Gallery.  My Studio, the place where you
upload your designs, only serves as a private repository (“in the cloud”).
— Display: the design is on the Gallery, but other members can only see images
and a 3D view.
— Full: the design is visible to all, other members can have the parts list,
can use EasyBuy, and (if you opt in) can download the .io file.

2. What’s forbidden (religion, military, violence, brands logos…) is set to Private
by the admins.

3. What’s IP protected is set to Display (or rather, is not accepted to Full). 
IP (mostly) means copyrights and trademarks.  That includes anything that says
it is, or obviously is, based on someone else’s brands or designs.

So, for official sets:
— If you build an official set in Studio and put it on the Gallery, it’ll be
Display.
— If you build a MOD of an official set (“hey, look what I built with the parts
of set XXX”), it’ll be Display.
— If you build a MOC that complements an official set (“hey, look, a 3rd floor
for modular 10xxx-1”), it’ll be Display.

So I can publish released LEGO sets so long as no one can download them?

[...] On the Gallery, yes, you’re limited to Display only. Elsewhere, they can be fully downloadable.  (For instance, Eurobricks & LDraw’s OMR have some.)
