I think someone went and purchased their minifig anyway.
Looking at this Help Topic, which I found from searching for "minifigure",
in the Help Center link found at the bottom of every BrickLink page, there doesn't
seem to be anything illegal about listing these minifigures:

You might be out of luck if you don't like the seller's gimmick. Maybe
he got a sale of a minifig he did want to sell.
